Private Pilot Maneuvers Multimedia Training Software
This is a legal agreement between the purchaser of this license and the end user ("you") and Jeppesen. Opening the CD and removing the Jeppesen Software ("Software") constitutes acceptance of the terms and conditions of this Agreement. If you do NOT accept them, promptly return the package with the CDs UNOPENED to Jeppesen along with all associated materials, and your license fee will be refunded.
1. License.
This Software is licensed, not sold. Jeppesen grants to you the nonexclusive, nonassignable right to use the Software for as long as you comply with the terms and conditions of this Agreement. Jeppesen shall has the right to terminate this license if you violate any of the provisions of this Agreement. You may use the Software on a single computer only. You may physically move the Software from one computer to another, provided that the Software is used on only one computer at a time. The Software may NOT be moved electronically from one computer to another over a network, and you may NOT provide use of the Software through a network of computers to users who are not individually licensed to use the Software. You may not rent or otherwise provide this software to a third party without a multiple-user license agreement.
Multiple User License
Some of the restrictions in the previous paragraph are waived if you purchase a multiple user license.
2. Copyright and Restrictions.
The Software is owned by Jeppesen and the copyright notices appearing on the package and CD label protect the Software and other copyrightable works embodied in the package. You may NOT modify, adopt, translate, reverse engineer, decompile, disassemble, rent, lease, or resell the Software, and you may NOT create derivative works based upon the Software or any part thereof. Any unauthorized reproduction, use, or transfer of the Software may be a crime and may subject you to damages and attorneys' fees.
3. Termination.
This Agreement shall remain in effect until terminated. This Agreement will terminate immediately without prior notice from Jeppesen if you fail to comply with or violate any of the provisions of this Agreement. In the event of termination of this Agreement, you shall either destroy the Software or promptly return it to Jeppesen.
4. Warranty Disclaimer; Limitation.
THE SOFTWARE AND ANY DOCUMENTATION ARE DELIVERED "AS IS," AND ARE NOT GUARANTEED TO BE FREE FROM ERRORS OR DEFECTS AND YOU ASSUME ALL RISK AS TO THEIR PERFORMANCE. JEPPESEN MAKES NO IMPLIED WARRANTY OF ANY KIND WITH RESPECT TO THE SOFTWARE OR DOCUMENTATION, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. JEPPESEN'S ENTIRE LIABILITY AND YOUR EXCLUSIVE REMEDY SHALL BE, AT JEPPESEN'S OPTION, EITHER (A) REFUND OF THE PRICE PAID FOR THE SOFTWARE OR (B) REPLACEMENT OF THE SOFTWARE. UNDER NO CIRCUMSTANCES WILL JEPPESEN BE LIABLE FOR INCIDENTAL, CONSEQUENTIAL, OR OTHER DAMAGES WHATSOEVER, REGARDLESS OF THE FORM OF ACTION, ARISING OUT OF ANY CLAIM THAT THE SOFTWARE IS DEFECTIVE, INADEQUATE, INACCURATE, UNRELIABLE, UNSAFE, OR FAILS TO CONFORM WITH ANY GOVERNMENT STANDARD OR REGULATION.
5. Miscellaneous.
This Agreement is governed by the laws of the State of Colorado and comprises the complete and exclusive agreement between the parties and supersedes all other agreements and communications between the parties relating to the subject matter of this agreement.
